5 Things That The Hipaa Privacy Rule Does And Doesn’t Allow

The Health Insurance Portability and Accountability Act (HIPAA) of 1996 led to significant changes in the way health care providers handle the information they get from their patients. It is important to know that HIPAA doesn’t just cover health care providers such as most doctors, clinics, hospitals, psychologists, dentists, and pharmacists that conduct their business electronically. The entities that are covered by HIPAA also include health plans like health insurance companies, HMOs, company health plans, and some government health care programs such as Medicare. Health care clearinghouses that are defined as those that process nonstandard health information into a standard are also covered by HIPAA.

The Privacy Rule included in HIPAA provides federal protections that have been put in place to protect the privacy of personal health information handled by covered entities. HIPAA, however, doesn’t just arbitrarily place restrictions on how this information is handled. The Privacy rule strikes a balance so that patient information can still be disclosed by health care providers without patient approval in certain situations. Here’s a closer look at what the Privacy Rule does and does not allow.

Health care providers can still freely share patient information even without a signed authorization from the patient involved if it is for the sake of treatment. Essentially, a physician can still consult with, for example, a specialist for the purpose of treating a patient without asking for the patient’s authorization first.

The Privacy Rule recognizes that it is not practicable and nearly impossible to fully protect against incidental disclosures. The Privacy Rule still permits certain incidental uses and disclosures of private patient information as long as the covered entities have reasonable safeguards and necessary policies procedures in place to protect the privacy of their patients.

Health care providers can still communicate with the families and friends of patients as long as the patient does not object. Under the Privacy Rule, health care providers can share and disclose information with those who the patient identifies as being involved with his or her care. In the event that a patient becomes incapacitated, health care providers are allowed to share the appropriate information if it is in the patient’s best interest.

Unless the patient objects, basic information like phone numbers, room numbers, and the patient’s general condition can be listed in the hospital directory or given out to people who ask for or come to visit the patient. Health care providers can also give out basic information to clergy even if the patient is not asked for by name. The Privacy Rule also does not prevent one from reporting child abuse or neglect to the proper authorities.

Finally, the Privacy Rule allows health care providers to continue communicating with their patients through electronic means such as through email, phone, or fax. As it is with incidental disclosures, this is allowed as long as appropriate safeguards that are used to ensure the privacy of patients are implemented.

Bangladesh security tightened following Pilkhana massacre and Bashundhara City fire

Following the Pilkhana massacre which occurred February 25 and 26 leaving 74 dead and the inferno at the Bashundhara City shopping mall complex March 13 leaving seven dead, Prime Minister Sheikh Hasina said security measures are being tightened countrywide across Bangladesh.

Fire drills will be enacted at all key-point installations (KPI). Fire fighting systems will be examined by the fire brigade and the public works department (PWD) to ensure functionality. Security measures will be enhanced supplementing areas under private security such as at the Bashundhara City Complex.

The Fire Service and Civil Defence Department requires modernization and needs new equipment to fight fires past the sixth floor of buildings. The Fire Brigade says it needs turntable ladders, snorkels, foam-tenders, lighting units, emergency tenders, fireproof uniforms, and rescue ropes for fire fighting and rescue operations. Transportation to fires is also an issue due to narrow roads, low electrical wires and congestion.

The Bangladesh National Building Code requires fire fighting equipment installed in buildings over seven floors. This code is to be monitored by authorities to ensure compliance with the new guidelines and to make sure buildings are being maintained.

The Bashundhara City Complex opened Monday for shoppers two days after Friday’s blaze. A probe is underway to determine the cause of the fire and to assess structural damage.

Loss of life was minimized as the blaze broke out on a Friday, the beginning of the weekend in Bangladesh, so offices in the upper floors were empty. The lower eight floors are used for shopping and the upper floors are all Bashundhara Group offices.

The mall is valued at Tk 7.0 billion (US$100 million). It is not known if the complex is covered by fire insurance.

It is estimated that it will take over two years to rebuild the area damaged by flames which were burned down to a skeleton. Bashundhara City’s technical advisor, Latifur Rahman, estimated damages at Tk 2.0 billion (US$29m).

Only one television cameraman has been allowed in to film the burnt area. None of the 2,500 shops, cinemas or cafes were burnt by the inferno. The seventh and eighth floors still experience smoke damage, and there was water damage to merchandise.

A three member committee is currently investigating the cause of the fire which will consist of Iqbal Khan Chowdhury, joint secretary of the ministry, representatives of the police, IGP Noor Muhammad, and fire brigade, Director General Abu Nayeem Md Shahidullah. The committee is required to report within the week with their findings. The forensics department is also sifting through the burnt remains.

The Dhaka Chamber of Commerce and Industries has also formed a committee which has begun interviewing witnesses and recording their testimony alongside the government committee.

It has been discovered that 150 closed circuit cameras were not being used when the fire started. Another mystery is why the mall fire fighting system has been found unused.

“In the shopping mall there is an ultra-technology elevator which runs even without electricity but we have found that locked,” Iqbal Khan Chowdhury, joint secretary (Police) of the home ministry, said. “Why the fire burnt so fiercely is a matter to think. We have to see if there was any incendiary substance there. These matters seem to be mysterious.”

Mall management has been asked to submit substances and items which would have been in the upper floors when the fire started. The fire erupted on the 17th floor and spread quickly to the two floors above and engulfed the three floors below. The aerial ladders belonging to the Fire Service and Civil Defence reached as high as the 13th floor of the 21-storey building.

Videos have been sent to the United States (US) for examination to assist in determining the cause of the fire and to help in the damage assessment. Experts from the US are expected to arrive soon.

Firefighters were brought to the rooftop of the 20-storey tower by helicopter. The only fatality in this operation was Baki Billa, a firefighter of Bashundhara City firefighting department, who fell when climbing down a rope from a helicopter to the roof of the building. Three other firefighters made the transition safely. At this same time, the chief security officer was safely rescued by the Bangladesh Air Force helicopter, a Bell 212. Six security officers of the complex also lost their lives.

So You Want To Build A Church…..

We neednt look further than I Chronicles 17:1-4 to capture the heart of the challenges of a church building project. Recall King Davids conversation with Nathan the prophet: Behold, I am dwelling in a house of cedar, but the Ark of the Covenant is under a tent. David felt guilty for living in a better-constructed, more comfortable place than the Ark, and Nathan advised him to follow his heart. There was one small problem, though: Later that night, the Lord instructed Nathan tell David not to build a new house.

All this applies today, when building projects can catapult churches to new levels of growth and momentum or cause them to spin out of control, leading to squandered resources and damaged reputations especially if the Lords hand isnt in it.

So, lets assume the Lord has told you to build His house whats next? In previous articles, weve examined the process of carefully master planning a building project, which includes determining your financial capabilities and evaluating the environmental, code, zoning, parking and water retention impacts of your land. Now youre looking to determine your churchs long-range goals as they translate to optimal space usage for ministry enhancement.

What if God Gives You a Dream?

In Bruce Wilkinsons new book, Dream Giver, the main character, Ordinary, pursues a big dream. What he doesnt realize is, the vision God gave him was a picture of the end result, not the beginning.

The ministry is full of people with big dreams who think the Lord wants them to fulfill such visions in their entirety right now. Instead, these visions might reflect the culmination of lifetimes work, not the starting point. Take Joseph, for example God gave him a dream. Little did Joseph know, however, the heartache and trials hed endure trying to make it happen. Nor did he realize his dream was the outcome, not the start.

As they relate to buildings and space, most ministry visions are limited to the lands capacity to handle parking, setback requirements and drainage issues, as well as the churchs financial capabilities and blessings. Once parameters regarding the maximum allowable square footage are established, its time to examine how your current space will enhance, or harm, the overall vision and master plan, and whether or not you need to start thinking instead about relocating.

Make the Most of What Youve Got

The other day, I visited a church that welcomes about 1,600 people on Sunday mornings. Feeling a space crunch, leaders wanted to modify their existing building to accommodate future growth. Given the facilitys total square footage about 25,000 I was surprised to find it so cramped. (One ministers office is even located in a 25-square-foot space originally intended to be a broom closet!) So, although this church can seat 1,500 people in the sanctuary, its administrative offices, classrooms, hallways, the narthex and fellowship spaces were grossly lacking.

To avoid a similar problem at your own church, follow a simple rule of thumb: For every person onsite at a given time, designate 45 to 50 square feet. For example, if you have a congregation of 500, youll need a total facility space, including existing areas, of 22,500 square feet to 27,500 square feet.

Unfortunately, many churches are caught in a catch-22: They dont have a strong enough giving base to support their growing attendance figures. If you fall into this category, how can you maximize your facilities?

Conduct a space analysis. The first step is to fully understand how you use, or dont use, your existing space. Imagine you own a 3,000-square-foot home where you, your spouse and five children live. Your bedrooms, living area and kitchen are large enough, but you only have a half-bathroom. Your tendency might be to look for a bigger house, adding to the living room, kitchen space and bedroom spaces when, in fact, you only need to add two bathrooms.

As it relates to your church home, heed a few more guidelines: Host multiple services. By reducing the number of people on your campus at a given time, you can significantly reduce your space needs. This is why so many churches have started offering two, three and four services.

Examine timing and use. When your congregation grows, conduct a solid assessment of what space is being used, by whom and at what times. Examine traffic patterns. This information might help you adopt ministry habits that are better suited to your current facility.

Consider temporary facilities. Once youve identified the major pressure points, you can add temporary facilities to your campus until building new becomes an option.

Consider Building Positioning, Proximity

Though Ive known many church leaders whove rushed out to build their next building without any thought to overall campus design, if you have a well-planned vision of your ministry needs, its time to start thinking about practical issues that impact the worship experience and everyday life. Some important questions:

How far will my people have to walk to get where theyre going?

What happens if it rains?

What will we do to facilitate handicapped and elderly visitors?

Will parents enjoy easy drop-off at the church?

Will the buildings position enhance or detract from its overall aesthetics and rooflines?

Although many of these might seem obvious, youd be surprised how often theyre thrown aside. The better you understand your vision and your people, the easier it will be to plan your new facility.

What Does Your Building Say?

Think for a moment about the buildings you pass every day, be they hotels, homes, businesses or other churches. How would you describe your first impression of each, and why? The Ritz Carlton, for instance, makes the statement that its guests are special and will be treated as such. On the other hand, some motels say, Were cheap, but well keep the light on for you.

What does your building say? Are your childrens spaces cramped, with blank walls, or do they sport colorful murals or interactive Disney esque play stations that shout, We care about our littlest members! Does your sanctuary look very sleek for the 1950s or does it meet your modern-day target ministrys demands?

The challenge for any church and its chosen design/construction team is to match ministry philosophy and construction costs with the statements you and your members want to make. Consider enlisting a group of non-members to offer their impressions. Do they mesh with your own vision of the church?

Financial Positioning, Phasing

Now, going back to the story of Ordinary in the Dream Giver, you must ask yourself if youre living the vision God has granted. Sure, you might have been shown a 150,000-square-foot campus on 45 acres, complete with a glassed-in sanctuary but youre currently worshipping in a 9,000- square-foot leased building, have $3,000 in the bank and welcome 300 worshippers per service.

One thing Ive learned about God is that Hes still in the business of miracles. Ive seen Him bless churches with facilities and building projects that seemed impossible without His involvement. On the other hand, Ive also witnessed ministry leaders run ahead of Him and falsely assume Hes going to complete their entire lifes work in one year, leading to disappointment and stalled projects.

Get Real About What You Can Afford

The next step is phasing your building project to match your churchs financial capabilities. Scriptures tell us to count the cost before building a tower to know our own limitations, not Gods. His power is unlimited; ours isnt.

In phasing a project, its extremely important to design the first phase within your ministrys means. Once this has been established, you can begin Phase 1.

No doubt youre asking yourself, Wheres God in all this? Its absolutely true that He can do it all…but will He? Plan Phase 1 to match your maximum human capabilities, seek wisdom in many counselors and then watch Him work.

Human remains in mass grave confirm Argentina secret death camp

During a seven-month search, the Argentine Forensic Anthropology Team (EAAF) on Tuesday, confirmed more than 10,000 charred human bone fragments were unearthed between February and September, in a pit at Pozo de Arana, a former La Plata, Argentina secret government detention center. The Arana prison or police station was used to torture prisoners during the so-called Argentina “Dirty War,” and was one of 300 used to interrogate Argentine prisoners.

The war refers to the state-sponsored violence against Argentine citizenry from roughly 1976 to 1983 carried out primarily by Jorge Rafael Videla’s military government. The exact chronology of the repression is still debated, as trade unionists were targeted for assassination as early as 1973. Isabel Martínez de Perón’s “annihilation decrees” of 1975, during Operativo Independencia, have also been suggested as the origin of The Dirty War.

The official record reveals that up to 13,000 people disappeared, while 30,000 were killed during this time. Argentine security forces and death squads worked hand in hand with other South American dictatorships in the frame of Operation Condor. An Argentine court would later condemn the government’s crimes as crimes against humanity and “genocide”.

EAAF president and forensic scientist Luis Fondebrider said that “in 25 years of searching, this was the first time that human remains were found at a former detention cente; the magnitude of what the team has found where the Clandestine Center of Arana was located, merits that sometimes they show partial results.” He further noted that “the bodies had been burned inside graves along with tires, combustibles and other material; and the possibilities of identifying some of these remains is low because of the state they are in.” Fondebrider concluded that “this scientifically confirms the testimonies of the detained, the hundreds of survivors who have said for years that authorities tortured, killed and burned the bodies of political opponents.”

The anthropological discovery further reveals that a wall with more than 200 bullet marks or holes and an “important quantity” of used ammunition shells on the ground nearby, were found adjacent the mass pit grave. As evidence of executions, they were marked with red paint by forensic scientists. The team, however, failed to determine how many bodies the fragments represented.

Maria Vedio, 47, legal chairwoman for the Permanent Assembly for Human Rights La Plata said that ” this is the first time there is proof that Arana wasn’t only a detention and torture center, but also a center of elimination.”

Sara Derotier de Cobacho, secretary of human rights for Buenos Aires said, “I ask the forgiveness of family members, because I can imagine what the mothers and all who are gathered here will feel, but what we are about to show is not to detail the genocide but so that we have proof for the trials that are to come; but let us not forget, that behind every clandestine center there were the names of the repressors. … so it is very important for all citizens to know those names; we are looking for the truth so we can attain justice and construct, from there, the memory of our 30,000 ‘desaparecidos’.”

Some of those responsible for the mass killings have been charged and meted life or death sentences. They include Miguel Osvaldo Etchecolatz, a senior Argentine police officer, who worked in the Buenos Aires Provincial Police during the first years of the military dictatorship known as the National Reorganization Process. He was convicted and sentenced to life imprisonment in 2006, on charges of homicide, kidnapping, and torture. The tribunal, besides handing the sentence, stated that Etchecolatz’s committed “crimes against humanity in the context of the genocide that took place in Argentina”. But the principal complainant, who was detained at Arana, has since disappeared.

Iranian International Master Dorsa Derakhshani discusses her chess career with Wikinews

In February 2017, the Iranian Chess Federation announced two teenage chess players, Dorsa Derakhshani and her younger brother Borna Derakhshani, were banned from representing the national team. The federation announced their decision although Dorsa Derakhshani had previously decided and informed the chess federation she did not wish to play for Iran.

Dorsa Derakhshani is currently 21 years old and holds the International Master (IM) as well as Woman Grand Master (WGM) titles. Her brother, Borna, plays for the English Federation and holds the FIDE Master title.

Dorsa Derakhshani was banned since she did not wear a hijab, an Islamic headscarf, while competing at the Tradewise Gibraltar Chess Festival in January 2017. Under the laws of Islamic Republic of Iran, hijab is a mandatory dress code. Her brother Borna Deraskhsani was banned for playing against Israeli Grand Master (GM) Alexander Huzman at the same tournament. Iran does not recognise the existence of Israel, and previously, Irani athletes have avoided playing against Israeli athletes.

Vitamin D deficiency more common, serious, than thought

Two scientists working at McGill University in Canada, reporting on their research and the research of other scientists, state in Scientific American that Vitamin D may have many uses in the human body besides building strong bones.

According to the scientists, Luz E. Tavera-Mendoza and John H. White, Vitamin D intake may also be beneficial in the prevention of cancer, multiple sclerosis, diabetes, and fighting tuberculosis, influenza and inflammatory bowel disease. The researchers say that there is an emerging “widespread consensus” among experts that a large part of the population has levels of Vitamin D in their bodies that is well below optimal concentrations for health, particularly in temperate regions, due to decreased sunlight and or less time outdoors, and during or just after the winter months. One study indicated that as many as 92% of adolescent girls in Northern Europe may have deficient levels of Vitamin D and 37% have severely deficient levels.

The problem is far worse among African-Americans than Americans with lighter skin. Almost half of African-American women may be seriously Vitamin D deficient, with presumably still another fraction deficient. Furthermore, the authors say researchers at Harvard University and elsewhere believe the FDA minimum recommended daily allowance of Vitamin D is far too low. The Recommended Dietary Allowance (RDA) ranges from 200 to 600 International Units (IU). In fact, the authors themselves take Vitamin D supplements. The first author takes 1000 IU during wintertime and the second author takes 5,000 IU in wintertime. They do caution, however, that there is a level at which Vitamin D becomes toxic.

Similar research has also been recently performed by researchers at the Queensland University of Technology who found that many elderly were likely not getting sufficient Vitamin D due in part to insufficient exposure to the sun.

2007 Taipei International Travel Fair: Taiwanese government promote premiums on tourism industry

2007 Taipei International Travel Fair (Taipei ITF), supported by governments with new premiums promoted by Executive Yuan in the future, started with a great new scale at December 14 to 17. In the opening morning yesterday, governmental people and ambassadors from several countries including Taiwan successively visited this show.

The show organizer, Taiwan Visitors Association (TVA), held 2 opening ceremonies for Cross-Strait Pavilion and the main show. In the side of Cross-Strait, several teams performed traditional entertainment shows like “Bian Lian” (Face-Changing) and Martial Arts of Shaolin Monastery (In Chinese: Shaolin Kungfu) successively at press conference and welcome reception yesterday and opening ceremony today. Participants from China and Taiwan hoped the relation from Cross-Strait can be improved with tourism industry.

In the main opening ceremony, Premier of the Republic of China Chun-hsiung Chang not only announced the premiums of “2008-2009 Visit Taiwan Year” but also said: “We (the Executive Yuan) will still encourage foreign visitors visit Taiwan and also provide premiums for groups with a charter airline. with our ‘2008-2009 Visit Taiwan Year’ in the future”.

Not only Chun-hsiung Chang, Minister of Transportation and Communications Duei Tsai, Commissioner of Tourism Bureau of MOTC Janice Lai, and the current President of Palau Thomas Esang Remengesau, Jr. visited this show. Former Scottish Conservatives leader Annabel Goldie to stand down as MSP

Annabel Goldie, Scottish Conservative Party leader from 2005 to 2011, has announced she will stand down as an MSP at the next elections in 2016. Goldie, who has been an MSP for the West Scotland (previously West of Scotland) electoral region since the Scottish Parliament’s formation in 1999, said she intends to focus on her role in the House of Lords, where she has been a peer since 2013.File:Annabel Goldie.jpg

In a statement today, Goldie said leading the party was an “enormous honour” for her. She also said: “It has afforded me both satisfaction and pleasure to serve my constituents and to serve the parliament and I will look back with great happiness at my time as an MSP. I am grateful to friends and colleagues from all parties for their support. Sometimes we found common ground, sometimes we disagreed but never I hope with rancour nor disrespect. Politics is a rough trade but we have built a strong parliament in Scotland of which we can all be rightly proud.” She said because of Ruth Davidson, her successor as Scottish Conservative leader, the party is now “in fine fettle and stands a great chance of making real progress in the years ahead,” concluding by saying: “I look forward to continuing to work as part of that effort in the House of Lords in the years to come.”

Davidson responded to the news by calling Goldie an “unstoppable force”, adding: “She has been an inspiration to a whole generation of Scottish Conservatives, and she has been a tremendous mentor, support and friend to me. In Holyrood, she has fostered both affection and respect from all members – regardless of their political affiliation – and her retirement from the Scottish Parliament will leave an Annabel-sized hole which won’t ever quite be filled. She is unique.” Meanwhile, David Cameron, UK Conservative leader and UK Prime Minister, said: “Annabel is one of those rare breeds in Scottish politics, somebody known by her first name alone. When she was Scottish Conservative leader, I valued her sage advice. She has been a towering strength to our party in Scotland, a doughty debater in the TV studios and Scottish Parliament and has one of the sharpest wits around. I wish her a long and happy retirement after 17 years unstinting service at Holyrood – but look forward to seeing her on the red benches of the Lords for years to come.”

Goldie, the Scottish Conservatives’ first ever female leader, was elected unopposed. She took up the role in the aftermath of David McLetchie’s resignation from the role in an expenses usage controversy and subsequent resignation of Brian Monteith from his Conservative whip role in the Scottish Parliament for briefing the media against him. Meanwhile, as Scottish Conservatives won 18 seats in the Scottish Parliament in 1999 and 2003, the party had been less successful in UK general elections in Scotland; Conservatives went up from zero out of a possible 72 UK MPs in Scotland in 1997 to one in 2001. This led to Goldie remarking in her inaugural speech in 2005 that: “The wheels are back on the wagon – and I’m the nag hitched up to tow it.” She also said: “The party is still way ahead of where it was in 1997. And my first task is to take it forward to 2007.” However, under Goldie’s leadership, the number of seats the Scottish Conservatives won in the Scottish Parliament slightly decreased from 18 in 2003 to 17 in 2007 and to 15 in 2011. At the same time, the number of Conservative MPs stood at one out of a possible 59 after the 2010 UK general election.

In the aforementioned 2005 speech, she also said the party could be trusted with devolution in Scotland, adding: “making devolution work better means real devolution: not the lumbering and cripplingly expensive array of government departments, government advisers, consultants, quangos, quasi-quangos and agencies with all their expensive appendages, but devolving down to people and their communities, their right to make their own decisions about their lives, how for example they procure healthcare and how they educate their children.” Goldie would go on to sit on the advisory board for the Smith Commission, which was set up to examine which further political powers should be devolved to Scotland following the 2014 Scottish independence referendum. More recently, Goldie supported a reduction in the voting age for Scottish Parliament elections from 18 to 16 in a vote earlier this month, commenting: “I think it is an opportunity for them to continue their high level of engagement in topical affairs that we saw with the independence referendum.”

Goldie, a member of the Salvation Army’s West of Scotland Advisory Board and a Church of Scotland elder, is not the only Scottish Conservative MSP intending to stand down in 2016. Mary Scanlon, Gavin Brown, Alex Fergusson and Nanette Milne all reportedly intend to leave the Scottish Parliament next year.
