Papua New Guinea Culture and Tourism minister charged with attempted murder

Police in Papua New Guinea have arrested the Culture and Tourism Minister, Guma Wau, and charged him with attempted murder. The host of Radio Australia’s Pacific Beat programme, Firmin Nanol, reported that the minister was charged and detained for an hour before being released on bail in connection with the shooting of a 50 year old man on June 13.

Minister Wau has said that he was driving through Kerowagi district when the road was blocked by local tribesmen who refused to let him pass, and as a result of this, he fired his pistol to break the crowd up. One of the bullets strayed and hit a local man, 50 year old John Agaundo, wounding him.

Police in Chimbu have confiscated his pistol for examination. Minister Wau is due to appear before Kundiawa District Court today.

New Zealander on oxygen machine dies after power disconnection

New Zealander Folole Muliaga died Tuesday morning after Mercury Energy cut off the power in her household due to $168.40 of unpaid bills. Mrs Folole Muliaga was seriously ill and dependent on an oxygen life support machine that required electricity to run.

The 44-year-old died two and a half hours after the power was cut by a contractor, working for State Owned Enterprise, Mercury Energy. A spokesperson for Mercury Energy has said that they are devastated and deeply sympathetic by the news, but state they did not know that the power was needed to run the oxygen machine. They have stated that discretion is exercised in cases of extreme hardship or when medical conditions make it appropriate and that the same contractor had done so the previous day. However, relatives claim that the contractor was told that the power was needed by family members present, was invited into the house and talked to Mrs Folole Muliaga, but showed no discretion or compassion under the circumstances.

The power was cut at about 11am. Brendan Sheehan, spokesperson for the family, said that after the power was cut, Mrs Muliaga suffered from breathing difficulties. During this time Mrs Mulianga declined an offer for an ambulance from family members. At about 1pm she informed her sons that she was feeling dizzy and asked for hymns to be sung. Her condition quickly deteriorated until she couldn’t speak. When she passed out at 1:32pm, an ambulance was called but Mrs Mulianga could not be revived when it arrived 12 minutes later.

That same evening remaining family members claim they had to grieve in the dark, power was only reconnected after the outstanding amount of $168.40 was paid to Mercury Energy. Mercury Energy claim that the were initially only made aware that a funeral was going to take place and attempted to reconnect the supply at midnight once the full circumstances were made clear but were unable to contact the family. They state the supply was eventually reconnected before 8am the next day. Evidence has been provided by family members to show that they had made two payments to Mercury Energy in the same month trying to clear their outstanding bill, $61.90 on 1 May 2007, and $45 on 17 May 2007.

Trevor Mallard, minister of State Owned Enterprises, said, “I do think it is important that the facts are established before people rush to judgement.”

Both the New Zealand Police and Mercury Energy, the retail operating division of Mighty River Power, are conducting investigations into the events.

The mother-of-four school teacher lived in Mangere, South Auckland and had been suffering from a heart and lung condition, according to relatives of Mrs Muliaga, since February.

Hospital doctors have expressed surprise at the short length of time between when the supply was cut and the death occurred. They have also explained that relatives are trained what to do if the supply is lost, including to call for an ambulance if severe symptoms develop.

Top broker and Wall Street adviser Bernard L. Madoff, aged 70, was arrested and charged by the FBI on Thursday with a single count of securities fraud, also known as stock fraud and investment fraud. He allegedly told senior employees of his firm on Wednesday that his $50 billion business “is all just one big lie” and that it was “basically, a giant Ponzi scheme (since at least 2005).” Mr. Madoff faces up to 20 years imprisonment and a fine of up to $5 million. FBI agent Theodore Cacioppi said Mr. Madoff’s investment advisory business had “deceived investors by operating a securities business in which he traded and lost investor money, and then paid certain investors purported returns on investment with the principal received from other, different investors, which resulted in investors’ losses of approximately $50 billion dollars.”

The former chairman of the Nasdaq Stock Market is also the founder and primary owner of Bernard L. Madoff Investment Securities LLC, the closely-held market-making firm he launched in 1960. The firm is one of the top market maker firms on Wall Street. He founded his family firm with an initial investment of $5,000, after attending Hofstra University Law School. He saved the money earned from a job lifeguarding at Rockaway Beach in Queens and a part time job installing underground sprinkler systems.

A force in Wall Street trading for nearly 50 years, he has been active in the National Association of Securities Dealers (NASD), a self-regulatory organization for the U.S. securities industry. His firm was one of the five most active firms in the development of the NASDAQ, having been known for “paying for order flow,” in other word paying a broker to execute a customer’s order through Madoff. He argued that the payment to the broker did not alter the price that the customer received. He ran the investment advisory as a secretive business, however.

Dan Horwitz, counsel of Mr. Madoff, in an interview, said that “he is a longstanding leader in the financial-services industry with an unblemished record; he is a person of integrity; he intends to fight to get through this unfortunate event.” Mr. Madoff was released on his own recognizance on the same day of his arrest, after his 2 sons turned him in, and posting $10 million bail secured by his Manhattan apartment. Without entering any plea, the Court set the preliminary hearing for January 12.

Madoff’s hedge fund scheme may rank among the biggest fraud in history. When former energy trading giant Enron filed for bankruptcy in 2001, one of the largest at the time, it had $63.4 billion in assets. The scheme would dwarf past Ponzis, and it would further be nearly five times the telecommunication company WorldCom fraud and bankruptcy proceedings in 2002.

The Securities and Exchange Commission filed a separate civil suit on Thursday against Bernard L. Madoff Investment Securities and its eponymous founder Mr. Madoff. It was docketed as “U.S. v. Madoff,” 08-MAG-02735, by the U.S. District Court for the Southern District of New York (Manhattan). SEC, New York associate director of enforcement, Andrew M. Calamari, asked the judge to issue seizure orders on the firm and its assets, and appoint a receiver. The SEC pleads, among others, that “it was an ongoing $50 billion swindle; our complaint alleges a stunning fraud that appears to be of epic proportions.” It further accused the defendant of “paying returns to certain investors out of the principal received from other, different investors” for years. Madoff’s hedge fund business had previously claimed to have served between 11 and 25 clients and had $17.1 billion in assets under management. But virtually all of the assets were missing.

United States District Court for the Southern District of New York Louis L. Stanton on Thursday appointed Lee Richards, a Manhattan lawyer, as the firm’s receiver. A hearing is set for Friday, for a ruling on the SEC’s petition to grant plenary powers to the receiver over the entire firm, and an absolute asset sequestration.

Doug Kass, president of hedge fund Seabreeze Partners Management said that “this is a major blow to confidence that is already shattered — anyone on the fence will probably try to take their money out.”

APEC closes in Sydney

APEC Australia 2007 has officially closed in Sydney, with Australian Prime Minister John Howard delivering APEC’s final declaration. The final leader’s declaration said that APEC member economies will support the Doha trade talks and that the leaders examined a series of measures to deal with terrorism, pandemics, contaminated food, energy security and natural disasters.

Mr Howard said that the APEC members had decided to make “An urgent request to all countries involved in the Doha process to renew their efforts to achieve an outcome, emphasizing that agriculture and industrial products are the two priority areas”.

The leaders wish for Doha to enter its final phase this year. Talks have been stalled due to disagreements between the European Union and United States over subsidies and tariffs for the agricultural sector.

A plan by the United States to establish an APEC free trade zone received a mixed reception with some members believing that such a move would weaken the group’s commitment to the Doha round. They did agree that if the WTO’s Doha talks were not completed by the end of the year, the APEC zone would be examined.

Speaking to CNBC, the head of the World Trade Organisation, Pascal Lamy said that negotiations taking place in Geneva were making progress.

“There is a strong sense that it is a make-or-break moment. It may take a few weeks, but my sense is that there is a lot of focus and energy,” Mr Lamy said.

In the area of health, the final declaration also promised to share influenza samples and provide equitable access to vaccines. Security related issues were a commitment to rooting out terrorism and a recognition of the danger proliferation of weapons of mass destruction poses to the region.

Despite interest from India and Pakistan in joining the group, it was announced that additional members will be considered in 2010.

The final declaration also reaffirmed the Sydney Declaration on climate change, which had been agreed upon on Saturday.

Suncor makes bid to take over Petro-Canada

Two of Canada’s largest energy companies are merging, with Suncor Energy making a CA$19.2-billion bid to take over Petro-Canada.

Suncor shareholders purchased $19.2 billion in stock and now own about 60% of Petro-Canada. Petro-Canada shareholders own the remaining 40%.

Suncor is reported to be the third largest Canadian energy producer, and Petro-Canada is Canada’s sixth largest. The current market value of Petro-Canada is $14.4 billion.

“This is a made-in-Canada response to the challenges presented by global market uncertainty. More importantly, it’s a made-in-Canada strategy to unleash the potential of these two companies and their people in the future,” said Ron Brenneman, chief executive officer of Petro-Canada.

“We need to face head-on the issue of global competition in a time of economic uncertainty. In these difficult times, we believe that joining forces provides the strength we need to be a leader in value creation in an extremely competitive industry, added Brenneman.”

Petro-Canada shares on the Toronto Stock Exchange (TSE) rose from $29.65 to $36.77, a 24% rise, while Suncor shares rose from $30.90 to $32.12, up 5%, at mid-morning.

“The merger will be good for shareholders of both companies with reduced capital requirements, operating efficiencies and complementary integration opportunities between upstream and downstream assets. The increased scale provides more stability in volatile markets, plus the financial and organizational capability to successfully take on large-scale projects in the future,” said Mr. Rick George, current Suncor chief executive and the next CEO for the merged companies.

Nicolas Sarkozy visited the UK today to celebrate the 70th anniversary since Charles de Gaulle made his war broadcast. The French president and the Prince of Wales laid wreaths at the statue of Charles de Gaulle in London.

Earlier, Mr Sarkozy and his wife Carla Bruni visited the BBC radio studio where the famous broadcast was made on BBC France. The broadcast at the time was said to have been listened to by a very small number of listeners. Carla Bruni and Nicolas Sarkozy unveiled a plaque and viewed a tapestry given to the BBC by France as a note of gratitude after World War II.

Nicolas Sarkozy and British PM David Cameron met with 200 veterans during a ceremony at the Royal Hospital Chelsea. Nicolas Sarkozy awarded the Légion d’honneur to six World War II veterans, three of whom were British.

In a short speech, Mr Cameron said the anniversary was a “reminder that Britain and France are not just neighbours in the geographical sense but also in the emotional sense.” Mr Cameron held an hour of talks with the French president at Downing Street primarily focusing on economics, Afghanistan, and other foreign policy matters. The visit is the first by a French president to mark Gen de Gaulle’s broadcast on June 18, 1940. In the stirring radio appeal, Gen de Gaulle declared himself leader of the “Free French”, spawning the French Resistance, which went on to play a crucial role in defeating the Germans.

Mr Sarkozy’s last official visit to the UK was in March 2008, when he was also accompanied by his wife.
