Injunction fails to stop decision on waterfront stadium in New Zealand

Today an injunction that was filed in the High Court yesterday to stop the Auckland City Council and Auckland Regional Council from telling the Government which stadium they prefer has failed. The decision is over a new stadium located on the waterfront of Auckland, New Zealand or an upgrade of the already existing, Eden Park, Auckland. The stadium is for the final of the Rugby World Cup 2011, which New Zealand is hosting.

The injunction was filed by a group of five Aucklanders who believe that the decision is being rushed. The injunction was filed in the name of a private citizen to represent a group of five Aucklanders. Rodney Hide, leader of the ACT party and Member of Parliament (MP) and MP for the Green party, Keith Locke, are helping the fight for the injunction as they believe the Aucklanders have a strong case.

Justice John Priestley said that the group did not need this injunction because they could fight the stadium decision in the future by different means. A second injunction has already been filed for two days, starting December 11.

Mayor of Auckland, Dick Hubbard, said: “The council’s advisors have informed that processes have been proper and appropriate.”

Rodney Harrison, Queens Counsel (QC), said: “The group that lodged the injunction were Auckland ratepayers, residents and concerned citizens but none of whom could be called high profile. I have no idea what those decisions might be. Exactly how the defendants (local government) react to central Government requests or pressure is a matter for them.”

ARC chairman, Mike Lee attacked his own counsel Brian Latimore for failing to follow instructions at today’s High Court injunction hearing. The instruction were “not to oppose any injunction, merely to assist the court by explaining what was going on and leave the argument to the judge and the other parties.”

Mr Lee said: “We were there as peacekeepers not combatants and it seems this guy has gone in and opened fire.”

Patrick McGuire, one of the five Aucklanders who had sought the injunction, said that Mr Hide had introduced all of them to each other after they each wrote a letter to him with their concerns. Mr McGuire said it requires “public input”.

Mr Hide said that he “had acted as a middle-man, arranging for the members of the group to meet with lawyers.” Mr Locke and Mr Hide are working together because they are concerned the legal processes of the decision over which stadium will be chosen and how the decision will be made. Mr Hide said he did not like the waterfront stadium, “I’m not a lawyer but the legal advice we have had is that the injunction has a high chance of succeeding.”

The two councils, Auckland City and Auckland Regional, have been consulting the affected groups to see which decision they should go with. The Auckland City Council is currently in a meeting discussing the stadium decision and the Regional Council will do it tomorrow.

If the waterfront stadium was chosen then the stadium will be located on Ports of Auckland land and they want a guarantee that their running of the ports will not be affected. Denis Carlisle, president of the local Maritime union, said: “The Ports of Auckland are asking for guarantees that they will not suffer any financial loss from the stadium project, and likewise the Maritime Union will be seeking compensation for our members for any loss of work. The issue was about safeguarding Port of Auckland’s role as a major working port.”

Hot dog eating champion retains title after tiebreaker

For the second year in a row, American competitive eater Joey Chestnut defeated his Japanese rival Takeru Kobayashi at the annual Nathan’s Hot Dog Eating Contest in New York City, after a tie forced a five hot dog eat-off to be held.

After ten minutes of hot dog eating, two shorter than in previous years, Chestnut and Kobayashi were tied at 59 frankfurters. But after the rare tiebreaker, 24-year-old Chestnut emerged as the winner, claiming a $10,000 prize and a mustard-yellow belt. “It was crazy,” he said. “I’m just a normal guy eating hot dogs on the Fourth. You can’t overcomplicate it.”

Kobayashi, whose loss last year shattered a six-year winning streak, said that a sore jaw and a tooth problem may have altered his performance. “If I put one more mouthful in, I could’ve won”, the 30-year-old Nagano native said through a translator. “I lost because I wasn’t quick enough in the rematch.”

This year, the 22 competitors were under a 10 minute time limit, unlike the 12 minutes used for previous contests. The reason for this, according to Nathan’s, was the discovery of a document from 1916, which revealed that the original competition was 10 minutes long.

Thousands gathered at Coney Island to watch the annual event, which has become one of the more colorful traditions of America’s Independence Day.

China overtakes Germany as world’s biggest exporter

Chinese officials have said that their country’s exports surged last December to edge out Germany as the world’s biggest exporter.

The official Xinhua news agency reported today that figures from the General Administration for Customs showed that exports jumped 17.7% in December from a year earlier. Over the whole of 2009 total Chinese exports reached US$1.2 trillion, above Germany’s forecast $1.17 trillion.

Huang Guohua, a statistics official with the customs administration, said the December exports rebound was an important turning point for China’s export sector. He commented that the jump was an indication that exporters have emerged from their downslide.

“We can say that China’s export enterprises have completely emerged from their all-time low in exports,” he said.

However, although China overtook Germany in exports, China’s total foreign trade — both exports and imports — fell 13.9% last year.

Many media outlets traditionally deliberately spread hoaxes on April Fools’ Day, including notable quality sources such as National Geographic and Science.

The popular British tabloid The Sun wrote that French President Nicolas Sarkozy is to undergo stretch surgery to make him taller than his wife, Italian artist and model Carla Bruni. The report claimed the 5 foot 5 inch leader would be made 5 inches taller in one year using a method by Israeli professor Ura Schmuck. The Sun noted that during his visit to Britain last week, Sarkozy had high-heel shoes while his wife wore a pair of flat pumps.

The Guardian on the other hand ran an article that suggested that Carla would head an initiative by Prime Minister Gordon Brown to bring more glamour, good taste and sophistication to the U.K. general population. This would involve collaboration with Marks & Spencer for high-street fashion and Jamie Oliver for meals and wine.

Boston’s Faneuil Hall selects 2005 performers

Boston, Massachusetts —After being postponed a week because of weather, on Saturday and Sunday, April 30 and May 1, Faneuil Hall Marketplace in Boston, Massachusetts, held public auditions for their 2005 performance slots. Thirty-two performance and musical acts got the coveted slots at one of the city’s popular tourist destinations. Benefits of performing in the Faneuil Hall/Quincy Market area include exposure and tips from passersby.

Although the auditions were open to the public, few people seemed to find the location for the tryouts, since they were held on the second floor of Quincy Market because of the weather. Were it not raining, they would have been held outside.

Acts vying for performance slots included Dan Foley, who has juggled chairs at the marketplace for several seasons, jugglers, and a contortionist. Musicians included The Vegas Valentinos, a loud rock and roll act reminiscient of Elvis; Apple Crisp, a father and son with a keyboard and a vibraphone; a few guitar/harmonica combinations; and Tom Bianchi, a familiar site among Boston street performers.

The emcee between musical acts tried to steal the show with bad jokes. Luckily, audience members steeled themselves and braved his jokes to listen to Toby Tobas’ steel drums.

The judges selected performers earlier this week. Entertainment will begin on Memorial Day weekend.
