Rebel leader, 56 inmates escape from East Timorese jail

Wednesday, August 30, 2006

East Timorese rebel leader Alfredo Reinado and other 56 inmates escaped last night from Dili‘s mail jail.

Australian and Portuguese forces initiated a massive manhunt for the escapees, which with their escape, created a new crisis for international security forces in East Timor. Australian SAS troopers using Black Hawk helicopters and night-vision goggles were involved in the search.

GNR‘s liaison officer, Lieutenant Cabrita told the Portuguese Rádio Renascença news agency that the prisoners took advantage of the relieve of guard to escape. “The evasion happened during the relieve of the forces that were serving in the jail’s security, having the escapees used vehicles for their escape”.

Later Australian police liaison officers confirmed the escape of the rebel leader. “It is understood 57 prisoners are currently unaccounted for, one of those being Mr Alfredo Reinado,” an Australian police spokesman said.

Alfredo Reinado is a former East Timorese Army officer who deserted and led a rebel group during the unrest in May, being blamed for some of the country’s violence during the security crisis.Him and other 14 soldiers of his rebel group were arrested on July by Australian troops for illegal possession of firearms after an GNR patrol found them with pistols, hundreds of ammunition and grenades in a house during a routine operation.

Of the other 56 prisoners unaccounted for, 16 are believed to be former Timorese police and soldiers accused of crimes committed during East Timor’s security crisis, and five prisoners convicted for homicide.

According to Becora’s prison warden Carlos Sarmento, the inmates had escaped by breaking down several walls on the prison’s east wing.

The East Timorese Justice Minister, Domingos Sarmento, blamed the international security forces for the jailbreak and told the Lusa news agency that the New Zealand forces in charge of the security of the prison’s exterior left the prison without informing the Timorese government.

“There was an agreement in which the forces of New Zealand would be in charge of the outside security of the prison, but about a week ago they left the location and didn’t inform us”, Domingos Sarmento said.

Domingos Sarmento said that he contacted the Australian-led forces so that the security outside the prison could be restored, but was told that the forces’ removal from the prison were due to the necessity of deploying troops in other points of the city.

The Minister recognized that the absence of police and military forces on the prison’s outside and the fact that the guard were unarmed contributed to facilitate the escape of the prisoners. Also recognizing that the use of weapons by the guards would improve the security in the jail, he noticed that the internal regulation doesn’t allow that use.

Is It Time To Electronically File Your Income Tax Returns In Canada

By Thor Hanso

The old saying goes that two things in life are certain: death and taxes. Although this is true taxes don’t have to be quite as painful as it was 15 years ago. Prior to the internet and personal computers for everyone filing your taxes was a terrible affair that required either an accountant or plenty of time. However, with the introduction of the internet filing your taxes is much easier than before.

However and quite surprisingly, is that not everyone in Canada files their taxes online. In fact, according to CBC in 2009 only 56% of tax returns were filed online. This means that 44% of the people are either using the old-cumbersome method of paper or using the automated telephone method, Telefile. Here is the breakdown of various tax-filing methods.

Paper – 11.29 Miillion returns (42.4%)

Netfile – 4.63 Million returns (17.4%) – The system that individuals use when filing their taxes through software applications like TurboTax, Ufile, etc

EFile – 10.24 Million returns (38.5%) – The system that tax professionals use to file other people’s taxes.

Telefile – 445,067 returns (1.7%) – An automated system used for VERY simple tax returns.

In this computer aided world where the internet, computers and various tax processing software making things easier it’s hard to see people filing their taxes with paper. However, over 11 million people filed their taxes with paper in 2009! The need for a paper version is fairly clear, however, for anyone with a slightly complex tax return the increased value in using a computer aided version must outweigh the costs of the software!

In fact, it would be interesting to know if people filing their taxes with paper missed out on money (ie: deductions) that they didn’t know existed. Did they get their full RRSP deduction, tuition transferred, investment income, etc Is it was worth saving the money for the tax-software? In addition, filing your taxes online provides a much quicker turn-around time for your tax-return if the government owes you money!

The next question is what are the costs to the tax-payers of Canada to have a paper-tax filing system? Surely an online tax filing method must be cheaper than paying government employees for data-entry. What about placing the paper-forms online so everyone can file online and the data-entry step is removed!

The Canada Revenue Agency’s NETFILE system, the system used to file your taxes online, is turning 12 this year. This means we’ve been able to file our taxes online for 12 years. In this time the citizen’s of Canada have gone from 0% filing online to 56% this is a huge increase but still much lower than expected from a computer dominated world! How many more years till everyone is filing their taxes online or till the government makes it mandatory to file online?

Like it or not taxes are complex and the amount of different government programs is hard to keep track. Might as well use a tax software where you simply fill in the required boxes, it checks your return for errors and provides all the calculations accurately. With the various tax-software platforms the cost associated with the software is very competitive and can be as in-expensive as $6.

A1GP New Zealand speeds its way into record books

Saturday, January 6, 2007

Jonny Reid, co-driver for the A1GP New Zealand team, today made history by driving the fastest over the 48-year-old Auckland Harbour Bridge, New Zealand, legally.

Mr Reid managed to drive the New Zealand’s A1GP car, Black Beauty at speeds over 160km/h seven times over the bridge. The New Zealand police had trouble using their speed radar guns to see how fast Mr Reid was going because of how low Black Beauty is, and the only time the police managed to clock Mr Reid was when he slowed down to 160km/h.

Black Beauty, like all the other A1 Grand Prix cars, is powered by a V8 engine, 3.4 litres and has a top speed of 300km/h. During the record attempt, it managed to get to 160km/h from zero in under three seconds.

The stunt was to promote the upcoming A1GP sixth round at Taupo in a couple of weeks, which Mr Reid will be racing because of his two wins at Indonesia, instead of other co-driver, Matt Halliday.

Mr Reid performed the record on the clipon lanes of the bridge which were closed at Christmas because the lanes were being resurfaced. The lanes will be open this Monday, January 8.

Mr Reid said the surface at the top of the bridge hadn’t been swept so it was quite slippery. “It was mega slippery at the top but we always knew that would be the situation and it was just great to show the public a little bit of what we were about.” However he also said that “It was fully under control.”

Mr Reid said the buzz from doing that, especially with the help from police, was huge. “I absolutely thrived on it. It was a very unique experience which you don’t come across every day. It was mega, it really was.”

Mr Reid assures everyone that the speeds he will be reaching in Taupo will be much, much faster than what he achieved today.

Once Mr Reid had finished crossing the bridge seven times, he finished with a few doughnuts.

Two cars were involved in a nose to tail crash on one of the northbound lanes trying to watch the action.

Clashes in Nigeria kill hundreds, troops on alert

Monday, March 8, 2010

According to witness and media reports, at least two hundred people in Nigeria have been killed after pastoralists and villagers clashed near the city of Jos, which has been the source of repeated tension between Christians and Muslims.

Local authorities, however, contradicted witness reports, saying that there were eight casualties, as did Mark Lipdo, an aid worker for the Stefanus Foundation charity, who reported that at least a hundred people were dead.

Witness reports state that pastoralists started firing into the air in the village of Dogo Nahawa, about five kilometres south of Jos, at night, and attacked those who emerged from their homes. “They came around three o’clock in the morning and they started shooting into the air. The shooting was just meant to bring people from their houses and then when people came out they started cutting them with machetes,” commented Peter Jang, who lives in the village, as quoted by Al Jazeera.

According to the Agence France-Presse news agency, some of the victims were children.

Acting Nigerian president Goodluck Jonathan said he had placed national troops on “red alert” following the clashes. “The acting president has placed all the security forces in the plateau and neighbouring states on red alert so as to stem any cross-border dimensions to this latest conflict,” read a statement released by his office. Armed forces are already present in Jos.

“The security services are on top of the situation,” said Jonathan’s spokesman Ima Niboro in an email statement to the Bloomberg news service.

In January, at least 400 people were killed and a further four thousand injured in the city of Jos after tensions between Christians and Muslims.

Search Engine Optimization, Google, And The Reptilian Code

By Jerry Bader

Search engine optimization dominates the thinking and to a large degree the marketing efforts of many small and medium-sized companies, but have you ever noticed that many of the largest and most profitable companies in the world ignore many SEO techniques.

Of course these companies have large advertising and marketing budgets that drive traffic to their websites and generate leads, sales, and most importantly customers; and they achieve these results without having to twist their Web-marketing message out of shape in order to satisfy search engine criteria.

Their prime interest is in delivering their finely crafted, focused marketing message to their audience, not to search robots. Last I heard search engines are in the business of selling you their stuff not buying yours. But these companies also know something that you don’t; they have a secret that makes their marketing work without the need for search engine appeasement. This secret is not much of a secret, in fact it is out there for all see; unfortunately most search engine crazed entrepreneurs choose to ignore it and instead look for an easy fix, a magic bullet, search engine nirvana.

Google’s Mission

Google’s success is based on two very simple facts: one, it is the best way to find what people are looking for on the Web; and two, it has parlayed this ability into a series of paid-for services. Pretty obvious stuff until you delve deeper into why and how this works. Google understands the same thing most extraordinarily successful companies understand and that is they know what you really want. The keyword here is ‘really:’ they understand the unconscious primal need to survive, to be the alpha-ape, to be first on page one of a search for whatever it is you do, because in the SEO game, if you ain’t on the leader board you ain’t in the money.

The Google Paradox

Here’s the problem: Google can only be successful as long as they deliver relevant search results to a vast Internet audience. If they fail to deliver appropriate search results people will stop using them and their paid-for services will decline. On the other hand, you as a business executive want access to Google’s vast audience, and the only way you think you can effectively gain this access is to appear on that first search page as close to the top as possible; and you really don’t give a damn how you get there. Enter the search engine optimization gurus, boffins, and Svengalis who provide the promise of survival of the most index-able.

So now we have Google who’s success is based on delivering relevant searches and SEO companies intend on manipulating this ability to place their clients on page one near the top. Google of course being a smart bunch of guys foils the SEOs by constantly changing their methods and algorithms and trumps them by placing paid-for results in the most prominent places. And the game continues, bringing in huge profits to Google and wonderfully large fees to the search engine optimization experts, leaving you paying the shot with little to show for it.

Just as an aside, I can tell you that most of our website traffic and subsequent inquiries and worldwide clients come from Google searches, and our website is mostly Flash, concentrates on Web-video and audio, and basically ignores most search optimization tricks. We rely on providing our audience and Google with relevant material.

Back to Basics

The lesson here is clear: sound marketing practices based on the way people think and act should be your number one priority, not blind faith in the manipulation of some constantly changing mathematical formula that is increasingly playing second fiddle to paid-for placement.

Persuasion Techniques

The ability to make money on the Web is not based on traffic but rather on your ability to communicate. High volume expensive traffic that leaves your site within seconds serves no financial purpose. You should be spending your marketing dollars on methods that grab visitors’ attention and deliver a focused, informative, entertaining and memorable marketing message that resonates with your audience’s unconscious desires formed in the primitive reptilian portion of the brain.

The Lustication-Justification Process

Sales are generated by creating what Clotaire Rapaille, the reigning superstar of market research, refers to as the process of lustication and justification. Lustication is the psychological trigger of desire that makes your audience want to buy your product or service, while justification is merely the rational excuse used to expend resources.

Decoding the Motivating Triggers

Rapaille’s work is all about decoding the motivating triggers that prompt a purchase. Once found, the job of the marketing effort is to stay on code. The major research effort is to get past the excuses, the justifications, the rational left brain thinking that appeases the accountants, engineers and programmers, and to get down to the nitty-gritty, the elements and primal coding that make us tick.

Rapaille believes words carry more than their literal meaning and are ripe with unconscious associations, not a surprising revelation since all communication whether verbal or nonverbal is based on the associations we make over a lifetime of experience. These shared associations form the basis of the code we are looking to play upon in our marketing.

Where most corporations and advertising agencies use focus groups as an exercise designed to cover their collective asses, Rapaille takes a different approach. As a trained psychiatrist, he organizes his version of focus groups in stages. During the first stage he allows his subjects to gain a sense of accomplishment by justifying their reasoning through logical and rational thinking that he completing ignores. In the second stage, he pursues the more relevant hidden aspects of desire, and that’s the ultimate sales trigger he’s looking for.

An Affordable Solution

Most businesses certainly can’t afford the fees of someone like Clotaire Rapaille, but if you free yourself from conventional thinking and the need to justify and rationalize everything you do then maybe you to can find the hidden triggers of desire that form the code you need to base your marketing on.

Humans have two fundamental needs, survival and improvement; these essential requirements are subdivided into our need for food, shelter, reproduction, acceptance, community, status, and knowledge; these are motivational triggers for everything your audience does and for every cent they spend. While you’re knocking your brains out competing for top spot on a Google search, the big boys are delivering what people really want, and laughing all the way to the bank.

If you want your share of the Internet pie, you best discover what really satisfies your audience’s hunger, because that’s the basis for a marketing message and website presentation that works.

Residents of Leeds, England neighbourhood plagued with crime ask council for help

Sunday, October 10, 2010

Residents of a Leeds, England neighbourhood have requested help from a council because their neighbourhood is plagued by crime, overcrowding, and community tensions.

Leeds City Council received a request for help from residents of Hyde Park, who said they were worried about the increasing level of anti-social behavior and worsening community relations. A report will be unveiled on Wednesday by a council delegation, highlighting the problems in the area. “The people living in Hyde Park come from widely different population groups… these groups have very different customs, needs and living styles and this can provoke high levels of tension in the area,” the delegation said.

The council claims that because of the 28 per cent ethnic minority population and the 40,000 students living in the neighbourhood, there are tensions between residents. They added, however, that they are actively encouraging people to work together, citing a multi-faith forum, a cricket competition and activities which bring old and young together.

The report says that the council are trying to build relationships between Muslims and police, something which they said is “particularly important after the area’s connection to the London bombings on 7th July 2005.” A local newspaper reported that “the Shebab project introduces young Muslims to role models from sport and culture and also runs scholars’ talks to counter extremist ideologies.”

Crime has increased by 7% in the past year in Hyde Park, and residents noted that anti-social behaviour was getting worse. The council said that an anti-burglary task force had helped to reduce the number of thefts from homes. Residents complained that there was a lack of pride in the area, and at the end of the academic year in the summer, large piles of rubbish were left in streets, yards and alleyways. The report adds that the council operates a recycling scheme aimed towards teenagers, and that rubbish collections have increased.

[We are] slightly frustrated with certain communication issues that we’ve had with the council

The Guardian reported on Wednesday that campaigners are attempting to “take control of a derelict school building and transform it into a community hub are appealing for sponsors and partners in a bid to turn their dreams into reality.” They say that the unused building, owned by the council, could be used for meetings and events. A volunteer group of residents have been working on a business plan, and have gained support from local businesses to create “a vision of an open, accessible and valuable resource for all.”

A member of the commitee, however, said he was “frustrated” with the council’s attitude towards the plans. “The RPCC is slightly frustrated with certain communication issues that we’ve had with the council, but we’re working with them and hoping to gain further assistance going forward,” he said. “It’s a shame that certain setbacks could have been avoided.”

The deputation added that “a major factor in Hyde Park’s suffering is its high level of population density”, which they conceded is something they are unable to change. The council responded to complaints that streets are “cheap and unhealthy takeaways, letting agents and boarded-up shop fronts,” by saying that Hyde Park Corner and Headingley are, according to the Yorkshire Post, “thriving shopping areas and work had taken place to ensure a good mix of outlets.”

The report concludes: “The council acknowledges that because of the very particular circumstances which exist in the neighbourhood, Hyde Park faces difficult challenges which affect the quality of life of residents and that ‘normal’ service levels may not be sufficient to tackle some of these. The council will do more to enable local people to influence how services work and how local problems are tackled. Local community and voluntary groups will be invited to play an active role.”

The Benefits Of Using A Talent Agency}

The Benefits of Using a Talent Agency

by

Idol Network

Struggling actors need all the help they can get and the easiest way to break into the acting scene is by working with a talent agency. These companies will make the connection between a soon to be actor and major studios. An agency can help you in more ways than you might think.

The main job of talent agency is to find casting auditions for its clients. Top agencies from around the country are always in touch with Hollywood studios and since movies are being made all year round, a role might be heading your way before you know it. The agency will give you a call and you will have to go and try out for the audition. If you get the role, the agency will take a small part of our paycheck. However, the benefits wont stop here.

Besides being called for auditions on a weakly basis, you will also receive legal support from your agent. Any problems that you might have with your employer can be settled through the legal department of these companies. Studios often have a tendency to take advantage of struggling actors, but you can be sure that a talent agency will always be on your side.

The whole idea of having an agent works so well because agents have connections with many actors and casting directors. They simply have to find the right actors and place in them in auditions. It is only a matter of time until every good actor will receive a spot on an acting job and if the actor knows what hes doing, he will certainly get noticed for other jobs.

In essence, the only thing that a soon to be actor has to do is find the right agency. After that, they will find auditions for commercials, movies and plays and you will simply have to figure out which job you want to accept. The process might be tiresome, but acting jobs will eventually appear.

Becoming an actor is one of the most challenging tasks you will have to do. Luckily, all you need is one big break and you will no longer have to struggle for getting an acting job because people will start looking for you. A talent agency will help you find the roles you want and they will take care of legal problems afterwards. Collaborating with an agency will bring many benefits, so dont hesitate about doing it.

Controversial development training cited in religious discrimination lawsuits

Friday, May 23, 2008

A controversial development training course called “Landmark Forum” is cited in religious discrimination lawsuits in United States federal courts in New York and Washington, D.C. The seminars are run by a San Francisco, California-based for-profit training company called Landmark Education. The company evolved from Erhard Seminars Training “est”, and has faced criticism regarding its techniques and its use of unpaid labor. The sperm bank and surrogacy company Los Angeles-based Growing Generations is named as a defendant in the New York lawsuit, and the Democratic political action committee Twenty-First Century Democrats is a defendant in the Washington, D.C. case.

In separate lawsuits filed in the United States District Court for the Southern District of New York in Manhattan, New York, and in the United States District Court for the District of Columbia in Washington, D.C., former employees are suing their employers for monetary damages and claiming religious discrimination after their employers allegedly mandated that they attend courses at Landmark Education.

In the US$3 million federal lawsuit filed in New York, Scott Glasgow is suing his former employer Growing Generations and its CEO Stuart Miller. Growing Generations maintains sperm banks and also arranges surrogacy for gay couples who wish to have children. The company has offices in New York and Los Angeles, and has done business with celebrities including actor B. D. Wong of Law & Order: SVU.

Glasgow was marketing director of Growing Generations, and claims he was fired in June 2007 after refusing to continue attending Landmark Education seminars. Glasgow is also suing for sexual harassment, and claims Miller came on to him in September 2006. He made approximately $100,000 per year as the company’s marketing director, and was the company’s only employee based out of New York City. The company’s main offices are in Los Angeles.

I want them to stop imposing Landmark on the employees, and I want an apology.

“I was shocked when I was fired. It took me months to right myself. I want them to stop imposing Landmark on the employees, and I want an apology,” said Glasgow in a statement in The Village Voice. Brent Pelton, one of Glasgow’s attorneys, stated that: “The Landmark philosophy is deeply ingrained in the culture of the company”. Glasgow said that the Landmark Education training courses were “opposite” to his Christian beliefs. According to Glasgow he was questioned by Miller in May 2007 after he walked out of a Landmark Education course, and was fired shortly thereafter. “We stand by the allegations contained in the complaint and we look forward to proving them at trial,” said Pelton in a statement to ABC News.

Ian Wallace, an attorney who represents Growing Generations, claimed that Glasgow wasn’t fired but walked away from his position. “Growing Generations and Mr. Miller are very confident that these claims will be dismissed ultimately, and there’s no factual basis for them whatsoever,” said Wallace in a statement to The Village Voice. Lawyers representing Growing Generations and Stuart Miller declined comment to The New York Post, and did not immediately return a message from ABC News.

In Glasgow’s complaint, entered into federal court record on April 18, he asserts that Landmark Education constitutes a “religion”, and “perceived their philosophy as a form of religion that contradicted his own personal beliefs”. He states that when he was promoted to Director of Marketing, he asked Miller if he could stop attending the Landmark sessions but was told that they were mandatory for all of the company’s executives and that Landmark is “very much the language of the company.” Glasgow said his performance at the company was assessed based on how he was “touching, moving and inspiring” others, a phrase from the Landmark philosophy, as opposed to his business accomplishments at the company. The complaint claims that the actions of Miller and Growing Generations violated Federal, New York State and New York City civil rights laws.

The lawsuit filed in federal court in Washington, D.C. deals with a separate plaintiff and company, but the plaintiff in the suit also claims that religious discrimination took place for allegedly being mandated to attend Landmark Education courses. Kenneth Goldman is suing the United States Democratic political action committee Twenty-First Century Democrats (also 21st Century Democrats) and its former executive director Kelly Young. Goldman was formerly the communications director of 21st Century Democrats.

According to Goldman’s complaint, three employees of 21st Century Democrats were fired after refusing to attend the Landmark Forum course. The complaint asserts that Landmark Education has “religious characteristics and theological implications” which influenced the mission of 21st Century Democrats and the way the organization conducted business. Goldman’s complaint states that in addition to himself, a training director and field director were also fired after they made it clear they would not attend the Landmark Forum.

Goldman says executive director Young infused Landmark Education jargon terms into staff meetings such as “create possibilities”, “create a new context”, and “enroll in possibilities”. He also claims that Young “urged” staff members to participate in Landmark Education events outside of the workplace, drove employees to and from Landmark functions, and used funds from 21st Century Democrats to pay for employees to attend those functions. Goldman’s complaint asserts that he was discriminated against in violation of the District of Columbia Human Rights Act.

While we are not a party to this lawsuit and have no firsthand knowledge of it, we can only assume that we are being used as a legal and political football to further the plaintiff”s own financial interests.

In a statement in The Washington Times, the executive director of 21st Century Democrats, Mark Lotwis, called the lawsuit “frivolous” and said: “we’re going to defend our organization’s integrity”. Landmark Education spokeswoman Deborah Beroset said that the Landmark Forum “is in no way religious in nature and any claim to the contrary is simply absurd,” and stated: “While we are not a party to this lawsuit and have no firsthand knowledge of it, we can only assume that we are being used as a legal and political football to further the plaintiff”s own financial interests.”

The New York lawsuit was filed April 14, and is still in early filing stages. A conference with the federal court judge in the case has been scheduled for June 17. The Washington, D.C. suit began in November 2007, and entered mediation this past March. As of April 15 the parties in the case were due back to court on July 11 to update the court on the mediation process.

Landmark Education is descended from Erhard Seminars Training, also called “est”, which was founded by Werner Erhard. est began in 1971, and Erhard’s company Werner Erhard and Associates repackaged the course as “The Forum” in 1985. Associates of Erhard bought the license to his “technology” and incorporated Landmark Education in California in 1991.

This is not the first time employees have sued claiming mandatory attendance at “Forum” workshops violated their civil rights. In a lawsuit filed in December 1988 in the United States District Court for the Northern District of Georgia, eight employees of DeKalb Farmers Market in Decatur, Georgia sued their employer claiming their religious freedom and civil rights were violated when they were allegedly coerced into attending “Forum” training sessions. “Many of these training programs, particularly at large corporations, claim to be purely psychological, aimed at improving productivity and morale and loyalty. But in fact they are religious,” said University of Denver religious studies professor Carl Raschke in a statement to The Wall Street Journal.

The DeKalb Farmers Market employees were represented by lawyers for the American Civil Liberties Union. Consulting Technologies Inc., an affiliate of Transformational Technologies Inc., was named as a party in the lawsuit. Transformational Technologies was founded by Werner Erhard, and was not named as a party in the suit. The “Forum” course that the employees claimed they were mandated to attend was developed by Werner Erhard and Associates. Employees said that they were fired or pressured to quit after they objected to the Forum courses.

The workers claimed that the Forum course contradicted with their religious beliefs. The plaintiffs in the suit included adherents of varying religious backgrounds, including Christianity and Hinduism. “The sessions put people into a hibernating state. They ask for total loyalty. It’s like brainwashing,” said Dong Shik Kim, one of the plaintiffs in the case. The plaintiffs said they lost their jobs after objecting to a “new age quasi-religious cult” which they said was developed by Werner Erhard.

The DeKalb Farmers Market denied the allegations, and an attorney for the company Edward D. Buckley III told The Wall Street Journal that employees were encouraged, not coerced, to attend the training sessions. According to The Wall Street Journal, The Forum said it would not sanction workers being coerced to attend its training sessions.

The parties in the DeKalb Farmers Market religious discrimination case came to a settlement in May 1989, and the case was dismissed with prejudice in June. The terms of the out-of-court settlement were not made public, but the employees’ attorney Amy Totenberg told The Wall Street Journal that the case “has made employers come to grips with the legitimate boundaries of employee training”.

According to Title VII of the Civil Rights Act of 1964, employers must “reasonably accommodate” their employees’ religious beliefs unless this creates “undue hardship”. In September 1988, the Equal Employment Opportunity Commission issued a policy-guidance notice which stated that New Age courses should be handled under Title VII of the Act. According to the Commission, employers must provide “reasonable accommodation” if an employee challenges a training course, unless this causes “undue hardship” for the company.

In October 2006, Landmark Education took legal action against Google, YouTube, the Internet Archive and a website owner in Queensland, Australia in attempts to remove criticism of its products from the Internet. The company sought a subpoena under the Digital Millennium Copyright Act in an attempt to discover the identity of an anonymous critic who uploaded a 2004 French documentary of the Landmark Forum to the Internet. “Voyage au pays des nouveaux gourous” (Voyage to the Land of the New Gurus) was produced by Pièces à Conviction, a French investigative journalism news program. The Electronic Frontier Foundation represented the anonymous critic and the Internet Archive, and Landmark withdrew its subpoena in November 2006 in exchange for a promise from the anonymous critic not to repost the video.

Landmark Education itself has come under scrutiny for its controversial labor practices. The company has been investigated by the United States Department of Labor in separate investigations originating out of California, Colorado, and Texas. Investigations focused on the heavy reliance of unpaid labor in the company’s workforce, which Landmark Education calls “assistants” and deems volunteers.

An investigation by the U.S. Dept. Labor based out of Colorado found that activities performed by Landmark Education’s “assistants” include: “office, clerical, telephone solicitation and enrollment, as well as greeting customers, setting up chairs, handling microphones during the seminars and making coffee. Additionally, a number of volunteers actually teach the courses and provide testimonials during and after the courses.” The Colorado investigation’s 1996 report found that “No records are kept of any hours worked by any employees.” According to a 1998 article in Metro Silicon Valley: “In the end the Department of Labor dropped the issue, leaving Landmark trumpeting about its volunteers’ choice in the matter.” Metro Silicon Valley reported that Landmark Education at the time employed 451 paid staff, and also utilized the services of 7,500 volunteers.

After an investigation into Landmark Education’s labor practices by the U.S. Dept. Labor’s offices out of California, the company was deemed to have overtime violations. According to the Department of Labor’s 2004 report on the investigation, back wages of $187,569.01 were found due to 45 employees. An investigation by the U.S. Dept. Labor in Texas which concluded in 2005 stated: “Minimum wage violation found. Volunteers (Assistants) are not paid any wages for hours worked while performing the major duties of the firm. The assistants set up rooms, call registrants, collect fees, keep stats of classroom data/participants, file, they also are answering phones, training and leading seminars.”

The Texas investigation also discovered an overtime violation. Landmark Education agreed to pay back wages for the overtime violation, but did not comply with the overtime violation found by the U.S. Dept. Labor for the “assistants”. Landmark Education denied that the “assistants” are employees, though the Department of Labor report concluded: “Interviews reveal that the employees are taking payments, registering clients, billing, training, recruiting, setting up locations, cleaning, and other duties that would have to be performed by staff if the assistants did not perform them.”

According to the 2004 investigative report by Pièces à Conviction in the “Voyage au pays des nouveaux gourous” program, Landmark Education was investigated by the French government in 1995. In the “Voyage au pays des nouveaux gourous” program volunteers were filmed through a hidden camera and shown performing duties for Landmark Education in France including manning phones, recruitment and financial work for the company, and one volunteer was shown cleaning a toilet.

Le Nouvel Observateur reported that after “Voyage au pays des nouveaux gourous” aired in France, labor inspectors investigated Landmark Education’s use of unpaid volunteers. According to Le Nouvel Observateur, one month after the labor investigation took place the French branch of the company had disbanded. A former “Introduction Leader” to the Landmark Forum, Lars Bergwik, has recently posted a series of videos to YouTube critical of the company and its practices. Bergwik appeared on a 2004 investigative journalism program on Sweden’s Channel 4, Kalla Fakta (Cold Facts). According to Bergwik, after the Kalla Fakta program on Landmark Education aired, “Landmark left Sweden”.
