Free Software Foundation releases first draft of GPLv3

The Free Software Foundation released the first draft for the next version of the GNU General Public License at the International Public Conference for GPLv3 in Cambridge, Massachusetts, USA, today. The revisions mark the first changes to the GPL since the second version was released in 1991.

According to Richard M. Stallman, the president of the Free Software Foundation, the most significant change to the license are changes to allow GPLv3 to be compatible with other popular free software licenses, notably the Apache Software License 2.0 and the Eclipse license. A second significant change, according to Stallman, is the addition of a clause prohibiting the use of GPL software for Digital rights management (DRM), “something for which there can never be toleration.”

As of noon EST today, the license is available in draft form on the Free Software Foundation’s website. The conference about the license, which continues now and into Tuesday, is being held in Building 10, Room 250, on the campus of the Massachusetts Institute of Technology. Approximately 200 people attended the morning session of the conference, during which Eben Moglen gave what he called a “quick” 90 minute overview of the license changes.

While Moglen’s presentation covered a great deal of legal detail, it was not without levity. When the cell phone of Dave Turner, an FSF staff member sitting in the front row, rang during Moglen’s speech, Stallman broke in, requesting of the audience, “If you have brought in a portable tracking and surveillance device, you should turn it off,” before making other remarks about the police.

The crowd at the conference included a large number of free software celebrities, including Bruce Perens, Andrew Tridgell, and Chris diBona. According to Wikinews reporter Brandon Stafford, it seemed that IBM and Sun were the corporations with the most employees present. Representing the companies were Bob Sutor, Craig Cook, and Mark Brown from IBM and Simon Phipps and Doug Johnson from Sun. Also in attendance were representatives from Intel, Redhat, MySQL AB, Hitachi, and Qualcomm, among others.

10 Tips For Winning At Custody

Winning at Custody is one of the most difficult issues parents confront in divorce. In many cases, both parents want custody and are willing to spend whatever it takes to win. Unfortunately, more than any other issue in divorce, to win at custody means that you have to be willing to prove your children’s other parent unfit. Custody is all about what is best for the children – and that involves proving that you are the best parent – i.e. that the other parent is not as good a parent as you and/or that the other parent is just simply a bad parent.

My recommended tips for winning at custody are:

1. If you are not involved in your children’s lives now, you are not getting custody from a judge. If you are a working parent who lets your spouse handle all of the details of parenting, you are not prepared to win at custody. You must either change your objectives or change your parenting. If you really want custody, get involved now – in all aspects of your children’s lives. Get involved in your children’s schooling. Attend their extra curricular events. Take them to the doctor and dentist. Get to know what professionals your children see and be involved with them?

2. Make sure that you are not exposing your children to unsafe or unhealthy environments when they are with you. Are you involved in another relationship? Has there been more than one? Be very careful about exposing your children to your companion(s). Many judges, professionals, and other parents object to the children being subjected to other relationships too early in that process. More important, if you really want to win at custody, it should be because you want to spend time with your children parenting them. Spending time with someone else when you have the children is a recipe for losing at custody in court.

3. Do you put down your children’s other parent when the children are with you – either consciously or subconsciously? If you do, stop. One sure way to lose at custody is to hurt the children’s relationship with the other parent. A judge will consider whether a parent promotes or prevents the other parent’s access to and relationship with the children when seeking custody.

4. Winning at custody requires that you keep a calendar for everything. You need to be able to look back and remember details when it comes time to litigage custody. If you do not know when you had the children, what events you attended, where they were or you were or allof the times your spouse was not timely for a pick up or drop off, you will only hurt your own case. You can keep track on your own calendar, with your own journal, or with a professionally managed calendaring system.

5. Be on time…Be on time…Be on time. Few issues cause as much conflict as a parent who is persistently late in picking up or dropping off children. It irks the judges, it creates arguments with your ex or soon to be ex, and it stresses out the children. So, Be on time.

6. Be flexible. If the other parent wants to switch weekends or weekdays, do it if you can manage your schedule. When the time comes to tell the judge why you should have custody, you can tell the judge that you are the parent who makes sure that the schedule works. In a close case, this issue makes a difference.

7. Do not involve your children in the issues that are pending in court or with attorneys. Courts generally are very opposed to the children knowing the details of what are essentially adult issues. Children should be told that both parents love them and want to see them – that’s it. The children may see a psychologist and/or an attorney or other professional if the court directs that. The children can talk to those people about your case – you should not be giving them the details, especially if giving the details involves denigrating the other parent.

8. Winning at custody requires considering one other very important factor: where do the children want to live. It is not a good idea to coach your children on this issue. They will have an opportunity to tell what they want to either the court, their attorney or a psychologist. However, it is a good idea to know what they want. If they want to live with their other parent, you should not spend all of your time and money pursuing custody, unless you believe that it is unsafe or inappopriate for the children to live with that parent.

9. You do have to be willing to show why your children’s other parent should not have custody. So, you need to keep track of whether that parent is on time, involved, and flexible with the schedule. If that parent has any issues that affect custody, such as a history of mental health issues which impact his or her ability to care for the children or alcohol or drug addictions, you need to let the court know. Other issues that can and do affect custody determinations include the number and frequency of romantic relationships and the epxosure of the children to those relationship, the proper supervision of the children, and ensuring that the children attend school and see professionals such as a doctor and dentist when necessary.

10. Above all else, hire a good attorney and be open and honest with your attorney. Listen to your attorney, not some friend or relative who is sure about what you should do because they had a friend or a relative who got a better deal. If you are paying your attorney, listen to what he or she has to say.

Eurovision ’04 winner Ruslana discusses her paths as singer, spokesmodel, stateswoman and source of inspiration

First becoming famous in her native Ukraine in the 1990s, long-haired self-described “AmazonRuslana gained international recognition for winning the 2004 Eurovision Song Contest with her song “Wild Dances,” inspired by the musical traditions of the Hutsul people of the Ukrainian Carpathian Mountains.

In the five years since, Ruslana has decided to use her name and public status to represent a number of worthy causes, including human trafficking, renewable energy, and even the basic concept of democratic process, becoming a public face of Ukraine’s Orange Revolution and later serving in Parliament.

Currently, she is on an international publicity tour to promote her album Wild Energy, a project borne out of a science fiction novel that has come to symbolize her hopes for a newer, better, freer way of life for everyone in the world. She took time to respond to questions Wikinews’s Mike Halterman posed to her about her career in music and her other endeavors.

This is the fifth in a series of interviews with past Eurovision contestants, which will be published sporadically in the lead-up to mid-May’s next contest in Moscow.

New Zealand ‘Boobs on Bikes’ parade approved

The Auckland ‘Boobs on Bikes’ parade for next weeks annual sex industry convention, Erotica Expo which features naked woman on motorcycles has been approved by Auckland City Council’s events and promotion staff despite disapproval by Auckland Mayor, Dick Hubbard and 13 other Auckland City Council councillors.

The mayor and the other councillors have signed a petition to withdraw the permit. Hubbard said “I think such a parade down Queen Street is totally inappropriate because it’s shamelessly promoting a pornography trade fair. It’s particularly degrading to women.”

However, the organiser of the expo, Steve Crow, says Mr Hubbard’s opposition is morally based.

All other previous parades had been held informally. Steve Crow, organiser of the parade and expo said “He only asked the council and the police if they wished to be involved as a matter of courtesy, and the parade will go ahead regardless. It’s legal under New Zealand law. They can basically go to hell; we’re going to do it.” Crow said the only reason they asked for permission this year is to have police involvement for spectators’ safety.

A spokeswoman for the Mayor said “The proposed route for the tour would pass a kindergarten and school. It’s the councillors that have got upset about it due to huge public reaction by people saying they didn’t want it,” the council has received numerous complaints to the parade.

Bob McCoskrie, Family First national director said “[We are] offering support for the topless porn girls by making bras and sweatshirts available. Typical of Auckland weather, there’s a high likelihood it’ll either be cold and/or wet. We’re genuinely concerned for their welfare and health.”

The Councillors are meeting today, August 16, to try and withdraw the permit that gives the parade green lights throughout Queen Street. Their decision is due sometime late today.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.
